Plea against appointment of AJK Chief Justice
SC calls for AG assistance

The Supreme Court here on Monday sought assistance of Attorney General of Pakistan in a petition challenging the appointment of Chief Justice, Supreme Court of Azad Jammu & Kashmir. A three-member bench of the apex court comprising Chief Justice Iftikhar Muhammad Chaudhry, Justice Chaudhry Ijaz Ahmed and Justice Mahmood Akhter Shahid Siddiqui issued he notice to AG and adjourned the hearing for two weeks. Justice Syed Manzoor Hussain Gillani of AJK Supreme Court filed the petition through Advocate Akram Sheikh under article 184(3) of the Constitution.

The court also directed to club another petition from an AJK judge against his non-confirmation with the same matter. Justice Syed Manzoor Hussain Gillani in the petition said that having no other remedy or forum available to protect his legal and Constitutional rights from being prejudiced at the hands of the Government of Pakistan, the petitioner invokes the kind indulgence of this August Court being the ultimate arbiter of justice for the territories comprising Pakistan. The petitioner had prayed the court to issue directions to the Prime Minister for issuance of a fresh advice for appointment of the petitioner as the Chief Justice Supreme Court of AJK, with a direction to the President of the AJK to act upon the advice instantly.

Advocate Akram Shiekh appeared before the court apprised that appointment of the Chief Justice was made irrespective of the law pointed out by the working paper. Chief Justice Iftikhar Muhammad Chaudhry asked the counsel about jurisdiction of Supreme Court of Pakistan and said `we do not want to interfere in other country’s domain’.—NNI
